Learned advocate appearing for the petitioner submits that in respect of the civil suit which has been dismissed for default, restoration application has been preferred. The issue is relating to the plot of land-in-question.

According to the State, police authorities acted pursuant to directions passed by the learned Civil Judge.

In case the civil suit is restored, petitioner would canvass his grievance as the original payer in the suit was for restoration of possession.

Since the civil court is not in seisin of the issue at this stage, it would not be fit and proper for this Court to pass any directions upon the State or

the private respondents.

Petitioner would first approach the civil court for restoration of the civil case thereafter only the issue can be considered. With the aforesaid observations, WPA 18299 of 2024 is disposed of.

There will be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
