The instant writ petition has been filed seeking implementation of the order of demolition dated 21st June, 2023 passed by the Commissioner, BMC.

The petitioner lodged a complaint which was considered by BMC and order of demolition has been passed. The order of demolition has been challenged in a separate writ petition being WPA 16566 of 2023 (Smt. Sandhya Saha -Vs- Bidhannagar Municipal Corporation & Ors).

In the matter of Smt. Sandhya Saha -VsBidhannagar Municipal Corporation & Ors (S), the Court has directed the Corporation to keep the order of demolition in abeyance till the matter is decided afresh.

In view of the above, the prayer made by the petitioner in the instant writ petition cannot be allowed at this stage.

The writ petition fails and is hereby dismissed. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
