Ms. Anasuya Sinha Mr. Jonaki Saha ...for the State It is submitted by Mr. Alokesh Dalai, learned advocate for the appellant that the appellant has already served the entire sentence and he is released from the correctional home on expiry of the period of sentence. Therefore, the appellant does not want to proceed with the instant appeal. The appellant is personally present in Court. The Court has explained to him that in the instant appeal he can challenge the order of conviction but the appellant is not willing to challenge such order of conviction.

In view of such circumstances, the instant appeal be dismissed for non-prosecution.

The letter of instruction given by the appellant to his learned advocate and the release certificate issued by the Superintendent of Krishnagar District Correctional Home in favour of the appellant be kept with the record.
