C.R.R.3357 of 2025 This is an application while petitioner has assailed the order dated 26th October, 2019 by which the court below on receipt of the charge-sheet issued warrant of arrest against the petitioner straightway.
Being aggrieved by the aforesaid order, learned counsel for the petitioner submits that he obtained bail from the trial court by an order dated 6th October, 2017 and thereafter due to proper instruction he was under the impression that he will not be required to attend court. However, the petitioner now wants to surrender before the court and for which he seeks for granting a leave.
Having heard learned counsel for the petitioner, it appears that the prayer made by the petitioner is innocuous and if
it is allowed in terms of the prayer, the opposite party will have no cause to prejudice and, as such, the service of copy of the application upon the opposite party is dispensed with. Having heard learned counsel for the petitioner, the leave is granted. Petitioner will be at liberty to surrender before the court below within a period of two weeks from the date of this order and in the event of such surrender, the court below will dispose of his prayer in accordance with law without being influenced by any observation made herein. The impugned order by which the court below had issued warrant of arrest against the petitioner dated 26.10.2019 is hereby stayed for period of two weeks or till the petitioner surrenders before the court below, whichever is earlier. Accordingly, the revisional application being CRR 3357 of 2025 is disposed of.
