Let the affidavit-in-opposition filed by the University Grants Commission be kept with the record. The petitioner before this Court claims to be an "Academic Collaborator" in terms of 5 (i) in the Singhania University, Pacheri Bari (Jhunjhunu) Act, 2008.
It is the grievance of the petitioner that the students passing out from Singhania University at Rajasthan, are not being permitted to register themselves under the West Bengal State Nursing Council.
It has further been submitted by the petitioner and the University that students passing out from the
said university do not require any registration under the West Bengal State Nursing Council.
Mr.
Anil Kumar Gupta, learned advocate appearing on behalf of the University Grants Commission submits that the students of this university have passed out from a study center at Bagdogra, West Bengal and such study center is not recognised by the University Grants Commission. I am unable to accept the contention as advanced by the university.
In my view, a student with a valid diploma or degree from a recognised institution should register himself with the Nursing Council of the concerned State in order to pursue his or her avocation.
I am, however, not inclined to deal with the dispute involved in the registration of the students under the West Bengal State Nursing Council.
I dispose of this writ petition granting liberty to the students of the Singhania University to apply before the West Bengal State Nursing Council seeking their registration. If the students make such application within one month from date, the West Bengal State Nursing Council shall consider their registration strictly in accordance with law within a period of one month from the date of making the application.
Needless to mention, the West Bengal State Nursing Council shall consider their registration
without being influenced by any observations made in this order.
Since it has been submitted by Mr. Bhattacharya, learned Senior Advocate that due to some technical reasons the students are not permitted to apply online, they will be at liberty to apply offline application. Accordingly, WPA 17576 of 2023 is disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with the requisite formalities.
