1. Petitioners are in custody for one year and three months. He submits there is no progress in the matter. He prays for bail.
2. Learned lawyer for the State contends charge has been framed and date has been fixed for recording of evidence.
3. We have considered the materials on record. Statements of witnesses before the Magistrate implicate petitioner in the murder. His bail prayer was rejected on merits earlier. After rejection of bail date has been fixed for recording of prosecution evidence.
4. Under such circumstances, we are of the opinion, this is a not a fit case to grant bail at this stage to the petitioner.
1. However, we request the learned trial court to expedite the trial and conclude it at an early date.
