Chakraborty ...for the petitioner The husband/plaintiff has filed this application under Article 227 of the Constitution of India challenging the order dated September 6, 2024 passed by the learned Additional District Judge, 1st Court at Alipore in Matrimonial Suit No.3267 of 2022.

By the order impugned, the order of ex parte hearing stood vacated and the written statement stood accepted.

After some argument, Mr. Roy, learned advocate appearing for the petitioner submits that a direction be passed upon the learned trial judge to dispose of matrimonial suit expeditiously.

In view of the order sought and proposed to be passed there is no necessity to direct issuance of any notice upon the opposite parties. However, the learned advocate for the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite parties or the learned advocates representing the opposite parties before the learned trial judge.

In the light of the submission made by the learned advocate for the petitioner, CO 2757 of 2025 stands disposed of without interfering with the order impugned but by requesting the learned Additional District Judge, 1st Court at Alipore to make an endeavour to dispose of the Matrimonial Suit No.3267 of 2022 as expeditiously as possible without granting any unnecessary adjournments to either of the parties.

There will be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
