Halder, Mr. Indranil Halder, Ms. Srabanti Das, Ms. Neha Singh .... for the petitioner Dr. Madhusudan Saha Roy .... for the CESC Limited Learned counsel for the petitioner seeks a new electricity connection at the premises, which has not been given by the CESC Limited, since the CESC Limited insists that a 'block meter' is required to be installed at the premises in view of multiplicity of wirings and large number of consumers at the locale. The said position is also evident from the communication dated December 21, 2019, which also specifies that the establishment is located in a market premise.

Learned counsel for the CESC Limited submits that the CESC Limited is duty-bound to adhere to the safety measures, for which a block meter has been insisted upon for giving connection to the petitioner,

keeping in view the large number of consumers located in a small area.

A perusal of the communication of the CESC Limited indicates that the concerned area is located in a market premise and there are a large number of consumers. It is also submitted by the CESC Limited that almost ten other applications are also pending for new electricity connections in the close vicinity of the petitioner's premises.

Keeping on balance the safety requirements and the right of the petitioner to get electricity, WPA No. 17581 of 2023 is disposed of by granting liberty to the petitioner to make a fresh application seeking electricity connection through a block meter. If such an application is made, and subject to compliance of all formalities by the petitioner, either in isolation or with other applicants, the CESC Limited shall process the same and give such electricity connection through a block meter to the premises as expeditiously as possible thereafter, preferably within two weeks from the date of compliance of all formalities by the petitioner and/or all the applications jointly.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
