It is submitted by the learned Counsel appearing for the petitioner that these petitioners are in custody for a long period and they have been falsely arrayed with the alleged crime. It is further submitted by the learned Counsel that one of the accused persons named in the charge sheet has already been granted anticipatory bail by this Court. So, these accused petitioners may be granted bail on the ground of detention behind the bar. 2.

Learned Counsel for the State vehemently opposes the prayer for bail. He says that there are sufficient incriminating materials in the case diary which show prima facie involvement of the petitioners with the alleged offence. Our attention has been drawn to the statements recorded under Section 164 Cr. P. C. which show prima facie involvement of these petitioners with the crime.

We have considered the rival contentions advanced by both the parties. It appears that the offence involved in this case is

serious in nature and sufficient incriminating materials have been gathered by the prosecuting agency against the accused person in the case diary showing their involvement with the alleged offence. 4.

In view of the aforesaid, we are not inclined to enlarge the petitioners on bail at this stage.

CRM (DB) 2301 of 2024 is, thus, dismissed.
