The records of the writ petition reflect that the learned Magistrate refused to accept the Final Report and directed for further investigation with certain observations.

It has been contended by Mr.

Sen, learned AAG, that the member of the SIT who was conducting the investigation has been altered pursuant to the direction passed by the learned

Magistrate.

Be that as it may, since the further investigation is in progress and judicial orders are being passed, I am of the view that it would not be fit and proper to interfere under Article 226 of the Constitution of India.

However, the petitioner would be at liberty to invoke the relevant statutory provisions for ventilating his grievances.

With the aforesaid observations, WPA 17395 of 2025 is disposed of.

Pending application(s), if any, is also disposed of.
