-VersusM/s Hindustan Earth Movers (Through Video Conference) Mr, Nitai Chandra Saha, ...for the Petitioners By filling the instant case the petitioner has prayed Hon'ble Consumer Disputes and Redressal Forum Rajarhat, New Town, 24 Parganas (N), may be directed for speedy disposal of CC No. 4 of 2021, where the petitioner has sought relief against the O.P./Promoter who failed to construct the house as per the sanctioned plan and design and as per the terms and conditions of agreement for construction dated 16.01.2018 entered into between the parties. The petitioner has alleged due to the pendency of such case before the concerned forum and non-completion of the construction by the O.P.

the petitioner has to reside in a rented accommodation by paying huge rent and by paying huge interest on the loan amount which he had obtained for construction of the house in question.

Considering such facts and the nature of relief sought by the petitioner against the O.P. the concerned Consumer Forum, is requested to dispose of CC No. 4 of 2021 expeditiously but regard being to the diary maintained by the Forum.

Since the petitioner has prayed for expeditious disposal of CC No. 4 of 2021, there is no possibility of causing any prejudice to the opposite party.

Further having regard to the nature of relief claimed, I see no reason to put the opposite party on notice. Service of notice on the opposite party is dispensed with. Accordingly, C.O. No. 2001 of 2021 is hereby disposed of.

There will be no order as to costs.
