The petitioner complains that the private respondent has raised illegal construction on P.W.D. land and has thereby obstructed ingress and egress of the petitioner.

The petitioner submitted a representation before the concerned authority in this regard on 23rd July, 2021 which is still pending. It is submitted on behalf of the respondents that pursuant to the representation of the petitioner, the Assistant Engineer, Pubic Works Department (Roads), the 2nd respondent herein, has sent a requisition to the Block Land and Land Reforms Officer, the 4th respondent herein, for demarcation of the land in question.

In view of the same, the writ petition is disposed of directing the 5th respondent to conclude the

proceedings within a period of three months from the date of communication of this order after giving reasonable opportunity of hearing to all the interested parties including the petitioner and the private respondent, in accordance with law.

WPA 18669 of 2021 is thus disposed of. However, there shall be no order as to costs. Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.
