The writ petition was disposed of by the order dated February 02, 2024, whereby the petitioner was allowed to be represented by one of his co-employees, a Physics teacher, viz., Ms. Mousumi Chatterjee in the disciplinary proceeding initiated against him.

This is an application for modification of the said order on the ground that the said teacher is not willing to represent the petitioner in the said proceeding.

Ms. Mookherji, learned Counsel for the school authority submits that such modification is not necessary because in terms of the rules governing the said proceeding, the petitioner is entitled to be represented by any of his coemployees. In view of the above, the modification of the said order as prayed for is not necessary I.A. No CAN 1 of 2024 is disposed of accordingly without any order as to costs. Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
