It appears that the petitioner approached this court on an earlier occasion by filing a Writ petition being W.P. No. 22957(W) of 2005 which stood disposed of by order dated 21st December, 2005 wherein the Court directed the Council to consider the case of the petitioner having Biodata No. 18323 in the next selection process to be conducted by the Council in the near future.

The next selection process of the Council was held in the year 2009. It appears that the admit card for appearing in the written examination held in 2009 was issued in favour of the petitioner.

It has been submitted by the learned advocate representing the respondents that the selection process conducted in the year 2009 is under challenge before this

court and an order has been passed by the court restraining publication of the panel. The selection process conducted in the year 2009 is yet to be concluded.

As it appears that the panel in question is under scrutiny before this Court in a pending litigation accordingly no relief can be granted to the petitioner in the instant case. The writ petition fails and is hereby dismissed. Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible. (Amrita Sinha, J.)
