In spite of service, none appears on behalf of Sri Sanatan Hansda, the private respondent no.8 herein.
The petitioner is alleging that the private respondent no. 8 has encroached upon the public land belonging to the Irrigation and Waterways Department, West Medinipur Division, Paschim Medinipur comprised in L.R. Plot No.83 under Mouza : Shyamsundarpur, Block: Debra, District : Paschim Medinipur and has put up permanent construction thereon. The petitioner is praying removal of the said unauthorized structure.
The petitioner has a pending representation praying the said relief before the Block Development Officer, Debra Block, the respondent no. 5 herein. The said representation
dated February 17, 2025 forms part of the writ petition being Annexure 'P-5'.
The respondent no.5 is directed to dispose of the said representation expeditiously in accordance with law, preferably within a period of six weeks from the date of communication of this order, after giving the petitioner, the private respondent and all concerned an opportunity of hearing.
The Officer-in-Charge, Debra Police Station, the respondent no.7 herein is directed to see that no further construction is carried out on the subject land till the disposal of the said representation.
Since no affidavit has been invited, the allegations made in the writ petition are deemed to have been denied by the respondents.
WPA 17587of 2025 is disposed of with the above terms without any order as to costs.
