Petitioner claims to be share cropper/ Bargadar who is being restrained from carrying out his cultivation. It has also been contended that the private respondent nos. 7, 8 & 9 have affixed a flag of a political party and is restraining him from carrying out the work of cultivation.

Police authorities have already drawn up proceedings under section 126 of the BNSS.

Having considered the nature of the issue which has resulted because of the dispute and difference of the private respondent and the petitioner, I am of the view that it would be in the fitness of circumstances to approach the jurisdictional Civil Court.

Police authorities would interfere only if there is violation of any law and order.

With the aforesaid observations WPA 17516 of 2025 is disposed of.

Report submitted be kept with the record.

Copy of the report be handed over to the learned advocate appearing for the petitioner.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
