1. Heard the submissions of both the learned advocates for the parties.

2. Perused the materials in the case diary.

3. On careful perusal of the materials available in the case diary, more particularly the statements of various witnesses recorded under section 180 BNSS, it is seen that both the parties are relatives with each other and there is no such incriminating materials found from the fourcorners of various statements against the petitioners to support the contents of the F.I.R.

4. The investigation is still going on and it is submitted by the prosecution that provisions of section 35(3) of BNSS have been duly complied with by the petitioners.

5. In view of the above, this Court is inclined to grant anticipatory bail to the petitioners subject to fulfillment of conditions stipulated in Section 482(2) of BNSS.

6. Accordingly, it is directed that in the event of arrest the petitioners shall be released on bail upon furnishing bonds of Rs.10,000/- (Rupees Ten Thousand only) each, with two sureties of like amount each, one of whom must be local, to the satisfaction of the arresting officer and also be subject to the conditions as laid down under Section 482(2) of BNSS and on further condition that the petitioners shall cooperate with the investigating officer.

7. This application for anticipatory bail is, thus, disposed of. (Chaitali Chatterjee (Das), J.)
