Petitioner is aggrieved by the fact that although the civil court has passed an ad interim injunction in favour of the private respondents, but the same is for a limited part of the property. Petitioner complains that petitioner is also having right, title and interest over an adjoining part of the property in which there has been continuous interference, quarrel, hot altercation and assault at the behest of the private respondents. To that effect, informations have been furnished before the police authorities, but no steps have been taken.

Police report reflects that a land dispute is existing between the petitioner and the private respondents. T.S. Case No.135 of 2023 is pending before the learned Civil Judge (Junior Division), 2nd Court, Tamluk.

So far as the incident complained of, according to the petitioner, occurred on 06.05.2025. The police authorities on enquiry did not find any genuinity regarding such accusations.

Be that as it may, there is a dispute between the petitioner and the private respondents which is admitted. Since civil and criminal cases both are pending, if there is any violation of law and order, police authorities would oversee that the same is not blown out of proportion. If there are other grievances since the jurisdictional civil and criminal courts are in seisin of the issues, the petitioner and the private respondents would be at liberty to bring the same to the notice of the concerned courts.

With the aforesaid observations, WPA 17517 of 2025 is disposed of.

There will be no order as to costs.

Report submitted by the State be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
