This appeal is against the order passed by the Learned Court of City Civil Judge, XIth Bench at Calcutta in Title Suit No. 880 of 2021 dated 08.11.2021.

This Court perused the order impugned wherein it reveals that the Judge-in-Charge has simply adjourned the case on the prayer of the defendant and fixed for hearing of the injunction application on 16.12.2021. This Court did not find any order refusing/granting injunction as prayed for by the appellant.

No order can be passed in the instant appeal. However, the appellant is at liberty to renew his prayer before the Learned Trial Court after notice to the defendant for early disposal of the injunction application.

Accordingly, FMA 1276 of 2021 with IA No. CAN 1 of 2021 stand disposed of.
