2023-12-15Hon'Ble Justice Prasenjit Biswas1 pages

15.12.2023 Srimanta Sl. Nos. 18 Ct. No. 655 CO/2084/2013 Duranta Pramanik -Vs.- Nil Ratan Makhal & Ors.

Petitioner is not represented.

There is no representation on behalf of the opposite parties.

It appears that the instant revisional application is preferred by the petitioner challenging the impugned order dated 25th August, 2011 passed by the learned Trial Court whereby the petition filed by the plaintiff praying for amendment of the plaint filed under Order 6 Rule 17 of the Code of Civil Procedure was allowed.

It further appears that on earlier occasion learned Counsel on behalf of the petitioner was present and the petitioner was directed to serve notice upon the opposite parties and file affidavit-ofservice today. But today there is no representation of the petitioner.

Accordingly, it appears that the present petitioner of this case has lost his interest to proceed with the present application. Accordingly, the revisional application being CO/2084/2013 is dismissed for default.

Interim order, if any, stands vacated.

There will be no order as to costs.
