1. Affidavit of service is taken on record. Despite service none appears on behalf of the nursing home.

2. The petitioner complains that the respondent no.3 has not given the discount of Rs.8000/-, as directed by the West Bengal Clinical Establishments Regulatory Commission.

3. The writ court cannot compel a private party to pay up the money. The petitioner is granted liberty to approach the West Bengal Clinical Establishment Regulatory Commission with the allegation that the order has not been complied with. However, the appropriate authority of the Health & Family Welfare Department, Government of West Bengal shall obtain information as to whether the nursing home had granted the discount of Rs.8000/-, by complying

with the order of the Commission. Such information shall be provided to the petitioner.

4. Accordingly, the writ petition stands disposed of.

5. All the parties are directed to act on the basis of the server copy of the order.
