Mr. Debanshu Ghorai, Adv.
...For the Petitioner Mr. Sanjay Dutta, Adv.
Mr. Sandip Kundu, Adv.
...For the State
1. It is submitted on behalf of the petitioner that he is innocent and he was not F.I.R. named accused person. Furthermore, he has been falsely implicated in this case.
2. Learned Prosecution raises objection and submits that there is a racket regarding this lottery business and custodial interrogation is necessary.
3. Heard the submissions made by the learned counsels for the parties.
4. Perused the materials on record and the Case Diary. After going through the statement recorded under section 161 Cr.P.C., considering the gravity of offence and since the investigation is still going on, this Court is not inclined to extend the benefit of section 482 of Bharatiya Nagarik Suraksha Sanhita.
5. Accordingly, prayer for anticipatory bail stands rejected.
6. Case Diary is, however, returned.
