Supplementary affidavit filed by the petitioner be taken on record.

The petitioner complains that he has been resisted by the private respondents and his sons from cultivation, to that effect information was furnished. Subsequently, the petitioner and his son both were subjected to assault at the behest of the private respondents.

On the other hand, learned Advocate appearing for the private respondents claim to be the sebaits of the property and complained of the petitioner trying to encroach upon the property under the garb of being a bargadar.

The State has conducted an enquiry over the accusation.

I find that the disputes complained of are between the bargadar and the sebait of the property. To that effect the police authorities have conducted an enquiry and

subsequently drawn up proceedings under Section 126 of the BNSS.

Having considered that the police authorities have limited scope to interfere in respect of the land dispute, the steps taken by the police authorities are in consonance with the provisions of law. However, by way of a supplementary affidavit the petitioner has annexed medical document. I have considered the medical document as well as the photographs. Having regard to the same, I am of the view that since the same was affirmed at a subsequent date and do not relate to the initial information. The petitioner would in such circumstances approach the jurisdictional Magistrate with specific prayers. Learned Magistrate would assess and ascertain regarding the nature of the accusations and thereafter pass necessary directions as the Magistrate deems fit and proper.

The police authorities would oversee that there is no violation of the law and order and would take steps in case the dispute continues and is blown out of proportion. With the aforesaid observations, WPA No. 17549 of 2025 stands disposed of.

Report submitted by the State be kept with the records. Copy of the report be handed over to the learned Advocates appearing for the other parties.
