The District Magistrate, Malda has made an enquiry with regard to the claim of the petitioners, pursuant to the order dated August 8, 2024.

The report filed by the State-respondents is taken on record. From the enquiry report, it appears that the petitioners had executed the work and Rs.30,45,000/- is pending to be released in favour of the petitioners. The photographs reveal that the toilets had been constructed by the petitioners. Under such circumstances, nothing remains to be decided in the writ petition. The District Magistrate, Malda is directed to ensure that the payment of Rs.30,45,000/- is released to the petitioners within October 31, 2024, without fail.

The time period is mandatory as in other circumstances the Court would have imposed interest, but refrains from doing so on the understanding that the District Magistrate, Malda shall ensure the payment within the aforementioned period.

The writ petition is, thus, disposed of.

There shall be no order as to costs.

All parties are to act on the basis of the server copy of this order.
