Banerjee) Mr. Rahul Karmakar Mr. Rajesh Kshetry Ms. Nilanjana Sarkar ...for the petitioners This application under Article 227 of the Constitution of India is at the instance of the propounder praying for a direction upon the learned District Delegate Judge, Barasat to dispose of Misc. Case No. 55 of 2024 (Probate) expeditiously.

Mr. Karmakar, learned advocate appearing for the petitioners submits that pursuant to the order passed by the learned trial judge the paper publication has already been made and citation has also been issued to the heirs of the deceased testatrix. Mr. Karmakar, submits that September 27, 2025 is fixed for taking steps. He further submits that no further steps is required to be taken by the petitioners as the petitioners have complied with all formalities with regard to issuance of general and special citation.

In view of the order sought and proposed to be passed, there is no necessity to direct issuance of any notice upon the heirs of the deceased testatrix. However, the learned advocate-on-record of the petitioners shall be obliged to forward a copy of this application along with this order, upon the heirs of the deceased testatrix or upon the learned advocate representing the heirs of the deceased testatrix before the learned trial judge.

In the light of the submissions made by the learned advocate appearing for the petitioners, CO 2770 of 2025 stands disposed of by requesting the learned District Delegate Judge, Barasat to proceed with the Misc. Case No. 55 of 2024 (Probate) in accordance with law and make an endeavour to dispose of the same as expeditiously as possible. (Hiranmay Bhattacharyya, J.)
