By a report dated January 13, 2023, the department brings to 16.01.2023 Sl. 1 wt2 Court No.29 (AD) the notice of the Court that, the appellant preferred two appeals against the same judgment of conviction and order of sentence. The first appeal being CRA 406 of 2015 was admitted on September 28, 2015. Thereafter, none appeared for the appellant.

The second appeal was admitted and numbered as CRA (DB) 155 of 2022.

The Court is informed that Legal Aid Society appointed an Advocate for the purpose of representing the appellant in CRA (DB) 155 of 2022.

Since two appeals cannot be preferred against the same judgment of conviction and order of sentence, it would be appropriate to direct the department to treat CRA (DB) 155 of 2022 as disposed of.

Learned Advocate appointed by the Legal Aid society for the appellant in CRA (DB) 155 of 2022 is requested to appear for the appellant in CRA 406 of 2015.

Legal Aid Society is requested to regularize the appointment of the learned Advocate for the appellant in terms of this order. List CRA 406 of 2015 before the appropriate Bench. (Debangsu Basak, J.) (Md. Shabbar Rashidi, J.)
