He alleges that it is difficult for him to use the passage leading to his premises, as an electric pole had been erected in the said common passage. The petitioner prays for shifting of the pole. It is submitted that the cost for such shifting has already been paid. According to the petitioner, the West Bengal State Distribution Company did not take necessary steps although the petitioner provided a map which indicated that the width of the passage at the northern side of the premises was 61' ft. and leaving 5' ft. aside, the pole could be fixed anywhere within
56'ft., on the northern side of the land in question. The map has been annexed to the writ petition. Learned Advocate for the West Bengal State Distribution Company submits that the private parties have raised objection.
Learned Advocate for the respondent no.6 submits that the respondent no.6 does not have any objection if the pole is shifted to any location which would not cause any impediment for the ingress and egress of the respondent no.6 Accordingly, the writ petition is disposed of directing the competent authority of the Domjur Customer Care Centre to cause an inspection of the concerned premises as also the premises referred to in the map supplied by the petitioner in the presence of the petitioner, respondent no.6 and any other interested party.
Accordingly, the authorities will select a position convenient for shifting and erection of the existing pole. The money has been paid by the petitioner. It is expected that all parties will cooperate. The shifting shall be effected with six weeks from date.
