VS.

The State of West Bengal & Ors.

Mr. Golam Mohammad .....for the petitioner Mr. T. M. Siddique Mr. Prantik Garai ......for the State This is an application seeking direction upon the respondent authorities to release the petitioners from the godown at Char Bajitpur by releasing ration cards of two villages, namely, Char Bajitpur and Char Shibpur in Murshidabad.

Affidavit of service filed on behalf of the petitioners is taken on record.

Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner is the license holder of a Fair Price Shop at Sahajadpur, District Murshidabad and is represented by its partners.

It was granted license in 2000.

Subsequently, two more villages were tagged with the concern. Due to advanced age of the partners, it is not possible for the petitioner to deal with such volume. Accordingly, the petitioner made a representation dated 14th May, 2022 to the respondent no. 4 for necessary

untagging. Yet, the same has not been considered till date.

Learned counsel appearing on behalf of the respondents submits that respondent no. 4 will be in a position to consider the representation of the petitioner in accordance with law within a stipulated time. Heard the learned counsels for the parties and perused the writ petition.

It appears that the petitioner is unable to deal with such volumes of ration cards since two more villages had been tagged with their concern. It has been made a representation in 2022, which remains pending.

In view of the above and in the interest of justice, I direct the respondent no.4 to consider the petitioner's representation dated 14th May, 2022 in accordance with law within a period of three months from the date of communication of this order.

With these observations, the writ petition is disposed of.

Urgent photostat certified copy of this order may be supplied to the parties expeditiously, if applied for. (Jay Sengupta, J.)
