Mr. Subhrangsu Panda, Ms. Mithu Singha Mahapatra ...for the Petitioners The State is not represented. No affidavit-inopposition has been filed by the State in terms of the order dated August 17, 2022.

It is the grievance of the petitioners that they are presently working as Associate Professors at Vidyasagar Metropolitan College, Kolkata. Respondent no. 7 is also an Associate Professor of the said college.

The petitioners submit that though they were appointed prior to respondent no. 7, they have been provided with a lower pay package than respondent no. 7.

It has, further, been submitted that they have made a representation before the Principal Secretary, Higher Education Department, Government of West Bengal by a letter dated May 21, 2022 with a copy to the Director of Public Instructions, Government of West Bengal.

Since the factual aspects involved in this case

cannot be appreciated without any affidavit-in-opposition from the State, I dispose of this writ petition giving a direction upon the Director of Public Instructions, Government of West Bengal to consider the said representation dated May 21, 2022, appearing at page 123 of this writ petition, in accordance with law by passing a reasoned order.

Before passing the reasoned order, the Director of Public Instructions shall hear all the necessary parties including the petitioners or their authorised representative.

Let such decision be made within a period of two months from the date of communication of this order. WPA 18030 of 2022 is disposed of.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
