The writ petitioner complains that the private respondent is disturbing his possession of his property.

The petitioner has lodged a complaint with the Daspur Police Station and yet there is no action. This Court is of the view that the remedy of the petitioner against the private respondent before a Civil Court.

The Officer-in-charge, Daspur Police Station shall, however, ensure that there is no breach of peace in the area.

With the aforesaid directions, the instant writ petition shall stand disposed of.

There will be no order as to costs.
