The petitioner's husband was admittedly an employee under the Income Tax Department, Government of India. The petitioner is seeking certain service related benefits. In view of the provisions of Section 14 read with Sections 28 and 3(q) of the Administrative Tribunals Act, 1985, this Court lacks the jurisdiction to receive, try and adjudicate the writ petition. The writ petition therefor is dismissed with a liberty to the petitioner to approach the jurisdictional Administrative Tribunal on the selfsame ground. The time spent between 18.07.2024 and today (19.11.2024) shall be construed to be the time spent in prosecuting a litigation bona fide before a Court without jurisdiction. (Arindam Mukherjee, J.)
