1. The affidavit of service filed in Court today is taken on record.

2. In view of the fact that the petitioner acquired her Ph.D degree on 3rd September, 2010 after coming into force the ROPA 2009 and the West Bengal Schools Control of Expenditure Act, 2005, we are of the view that the learned Single Judge was justified in not extending the benefit of two increments to the petitioner. The petitioner also cannot claim the benefit of the Government Order dated 12th February, 1999 as it was extended upto 18th August, 2005.

3. Under such circumstances, we do not find any reason to interfere with the order passed by the learned Single Judge.

4. The appeal stands dismissed. However, there shall be no order as to costs.

5. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
