Learned advocate appearing for the petitioner submits that the petitioner is detained in custody for the last 8 months on the accusation of seizure allegedly of brown sugar. Till date only charge-sheet has been submitted and there has been no progress in the case.

Learned advocate for the State opposes the prayer for bail and submits that 400 grams of brown sugar was recovered from the joint possession of the petitioner and another. Having considered that the recovery so made is of commercial quantity, I am of the opinion that Section 37 of the NDPS Act is attracted. As such, the prayer for bail of the petitioner in CRM(NDPS) 993 of 2025 is rejected.

However, learned trial court would expedite the process of progress of the present case.
