No accommodation has been sought for either.
The petitioners claim to be the recorded owners of Plot No. 1020 within Mouza Gholpukuria. Khatian No. 433/2 under Police Station Nandigram in the District of purba Medinipur.
The petitioners allege that the said property has been acquired by the railway authorities for the purpose of Deshapran Nandigram Special Railway Project but no compensation in respect of such property has been paid to the petitioners. The petitioners also claim employment in lieu of such acquisition. The petitioners submitted a representation dated 15th May, 2025 before the authorities of the South Eastern Railway.
The learned advocate appearing for the railway authorities submits that Plot No. 1020 was not acquired. Since the petitioners have submitted a representation praying for compensation and for
employment, it is the duty of the respondent authority to communicate their decision on such representation, if not already done in the meantime.
Accordingly, WPA 17542 of stands disposed of by directing the Senior Divisional Personnel Officer, South Eastern Railway, Kharagpur, Paschim Medinipur being the 2nd respondent to communicate the decision on the representation dated 15th May, 2025 as expeditiously as possible. If such respondent authority is of the view that the issue raised in the representation does not fall within his jurisdiction, such authority shall forward the same to the appropriate authority who shall thereafter consider the representation dated 15th May, 2025 and pass orders in accordance with law. It will be open to the respondent authority to afford an opportunity of hearing to the petitioners.
There shall be however no order as to costs.
Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
