Mr. Soumitra Bandyopadhyay Mr. Aniruddha Sen ..for the State One Patitpaban Roy, since deceased was the original owner in respect of the said land which was acquired by the National Highway Authority. The petitioners are the sons and grand sons of the said Patitpaban Roy, since deceased. They have prayed for compensation against acquisition of land. No compensation was paid to them, which prompted the petitioners to file the instant case. However, after initiation of the instant writ petition they received the compensation. Therefore, the conduct of the petitioners suggests that they are not willing to proceed with the instant writ petition. Practically even on the first date of hearing i.e., 14.12.2007 the petitioners never approached before this Court for any relief.
In view of such circumstances, the instant writ petition is dismissed for default.
