Affidavit-of-service so filed be kept with the record. In view of the order passed by the learned Judge, Special Court under N.D.P.S. Act-Cum-A.D.J, 4th Court, Alipore, 24 Parganas (South) refusing to return the seized vehicle by its order dated 12.08.2021, I find that a part of the order being relevant. In view of the settled proposition of law, I direct that the learned Special Court would assess regarding the ownership of the vehicle of the claimant and thereafter impose conditions for return of the seized motorcycle keeping in mind that the same is produced as and when required before the court in course of the trial. With the aforesaid observations, CRR 2360 of 2021 is disposed of.
