And In Re : Labani Maji @ Runa Maji @ Runa Bhowmick & ors. petitioners Mr. Soumya Basu Roy Chowdhury, ....for the petitioner Ms. Faria Hossain, Ms. Baisali Basu ..... for the State Apprehending arrest in connection with Bagnan Police Station Case No.340 of 2021 dated 13.07.2021 under Sections 498A/302/304B/34 of the Indian Penal Code and Sections 3/4 of the D.P. Act, the present application has been preferred. Heard learned advocates appearing for the respective parties and considered the materials in the case diary. It appears that petitioner no.1 is the aunt-in-law and petitioner nos.

2 and 3 are uncles-in-law of the victim and upon a cumulative assessment of the materials in the case diary and assessing the role of the petitioners herein, we find that they are similarly situated with the other co-accused persons who have already been granted anticipatory bail by an order dated 17th December, 2021 in CRM No.7985 of 2021. In view thereof and since upon completion of investigation chargesheet has been submitted, we are of the opinion that their custodial interrogation is not warranted.

Accordingly, we direct that in the event of arrest, the petitioners, namely, Labani Maji @ Runa Maji @ Runa

Bhowmick, Sudip Maji and Swapan Kapri, shall be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten thousand only) each with two sureties of like amount each, to the satisfaction of the arresting officer and subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973.

The petitioners shall attend the learned Trial Court on all the dates as specified for hearing.

The petitioners shall not intimidate the witnesses and/or tamper with evidence in any manner whatsoever. It is made clear that in the event the petitioners fail to comply with the aforesaid directions without any justifiable cause, the learned trial court would be at liberty to cancel the petitioners' bail without any further reference to this Court. The application for anticipatory bail being C.R.M. 7732 of 2021 is disposed of.
