Petitioner is aggrieved by the fact that his account has been unnecessarily being freezed in connection with Sonarpur PS Case No. 986/24 dated 18.07.2024. Petitioner claims that because of such act and action of the police authorities, petitioner is unable to withdraw the pension also since the account happens to be a pension account. Learned advocate appearing for the State submits that the investigation of the case is still in progress.

Having considered that the petitioner's main grievance and/or prayer before this Court is for defreezing of the account, the complicity or

innocence of the petitioner is required to be assessed. The jurisdictional Court is in seisin of Sonarpur PS Case No. 986/24. In case an application is preferred for defreezing of account, learned Magistrate would call for the case diary, thereafter assess regarding the complicity or innocence of the petitioner and thereafter pass necessary directions as he deems fit and proper within 45 days from filing of the application. With the aforesaid observations WPA 17562 of 2025 is disposed of.
