Being aggrieved by the order impugned passed by the Additional District Magistrate and District Land and Land Reforms Officer, Balurghat, Dakshin Dinajpur on 26.04.2022, the petitioner submitted a further representation before the concerned authority on 12.07.2022 and prays for a direction upon the authority for compassionate consideration of the said application. Learned counsel appearing for the petitioner submits that the petitioner comprises poor fisherman whose only source of livelihood is pisciculture and it is impossible for them to afford the lease rent at the government rate as decided in the order impugned.

It is submitted on behalf of the State-respondents that the 4th respondent be directed to consider the representation in accordance with law.

In view of the above, the writ petition is disposed of directing the 4th respondent to consider and dispose of the representation submitted by the petitioner on 12.07.2022

within a period of one month from the date of communication of this order, after giving reasonable opportunity of hearing to all the affected parties including the petitioner, in accordance with law.

With the above observations and directions this writ petition is disposed of.

There shall be, however, no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be furnished to the parties upon compliance of necessary formalities.
