Matter relates to transfer of a Group-D employee of Government aided secondary school. The learned advocate for the petitioner submits that transfer application was made on 17th August, 2022 on Utsashree Portal and the same was processed and forwarded by the school authority where petitioner is presently working, to concerned District Inspector of Schools (SE), Purba Medinipore and the said District Inspector of Schools in his turn has forwarded the transfer application to the West Bengal Central School

Service Commission on 7th September, 2022 for taking appropriate steps.

Petitioner prays for direction upon the Commission to decide her transfer application.

Respondents are represented by learned advocates who submits perhaps due to suspension of Utsashree Portal contemporaneous decision could not be taken on the transfer application of the petitioner.

However, it has been submitted on behalf of the Commission if direction is given upon the Commission the concerned authority of the Commission shall decide the transfer application of the petitioner.

Having considered the submissions made on behalf of the parties writ petition stands disposed of directing the Chairman of the Commission being respondent no. 3 to decide transfer application of the petitioner within 4 (four) weeks from the date of communication of this order in accordance with law and the decision to be taken by the respondent no. 3 shall be communicated to the petitioner by 1 (one) week thereafter. However, it is made clear that the transfer application of the petitioner shall not be rejected on the ground of suspension of Utsashree Portal.

There shall be no order as to costs.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
