Petitioner is aggrieved by the fact that she has been continuously receiving calls from a particular number for a period, at least from October, 2022 till November, 2024.

Police authorities in their report submit that Kritisom Manna had been using the phone number who is also the accused in Cyber P.S. Case No.97 dated 05.10.2020. The said case is pending before the learned Judicial Magistrate, 17th Court, Calcutta and trial of the case is in progress. Having considered that the petitioner being the complainant who has set the criminal law into motion and is a witness of the case and is being continuously disturbed, I am of the view that the

liberty relating to bail of the accused should be reconsidered by the learned Judicial Magistrate, 17th Court, Calcutta.

Petitioner would take out an application for cancellation of bail. Learned Magistrate would peruse the records of the number of phone calls which have been advanced, the period during which the investigation and the trial was in progress in connection with the case pending before him and accordingly, the learned Magistrate would pass necessary directions after hearing the accused. If such an application is preferred, learned Magistrate within a period of thirty days would dispose of the same in accordance with law.

With the aforesaid observations, the writ petition being WPA 17658 of 2025 is disposed of. There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
