28.07.2023 sdas rejected C.R.M. (DB) No. 2978 of 2023 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Raiganj Police Station Case No. 479 of 2019 dated 23.07.2019 under Section 364A of the Indian Penal Code.

It is also submitted that there is delay in trial. She renews her bail prayer. Learned Counsel for the State opposes the bail prayer and submits trial is in progress. 20 out of 26 witnesses have already been examined.

We have considered the materials on record. Allegations are grave and involve abduction for ransom and murder. Trial is in progress. Husband of the petitioner is absconding. There is possibility that the petitioner may abscond if released on bail. Under such circumstances her release on bail may derail the

prosecution. Hence, we are not inclined to grant bail to the petitioner.

The application for bail is, thus, rejected.

Trial court is directed to examine the prosecution witnesses expeditiously and conclude the trial at an early date preferably within one year from the next date fixed for recording evidence without granting unnecessary adjournment to either of the parties.
