11.09.2025 Item No.27 Ct.No.34 rc.

Reject C.R.M. (M) 1270 of 2025 In Re : An Application for bail under Section 439 of the Code of Criminal Procedure read with Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Chatterjeehat Police Station Case No. 105 of 2019 dated 21.06.2019.

And In Re :

Ranjit Bhor ... Petitioner Sk. Toslim Ali ... for the Petitioner Ms. Amita Gaur Mr. Arup Sarkar ... for the State The petitioner seeks parity with the co-accused who was granted bail by this Court after the bail prayer of the petitioner was turned down.

Learned counsel for the State opposes the prayer. I have considered the material on record. Bail prayer of the petitioner was turned down by this Court on April 10, 2025. On that day seven out of thirty seven witnesses were examined.

It appears from the report submitted by the State that on most of the dates after April 10, 2025, witness action was deferred at the instance of the petitioner and the co-accused. It is not acceptable that the petitioner and the co-accused protract the litigation before the learned trial Court and seek

bail before this Court on the ground of prolonged incarceration. On merits, the bail prayer of the petitioner was turned down as recently as on April 10, 2025. There is no change in circumstances which warrants a favourable order at this stage.

The co-accused who has been granted bail is a lady. The petitioner cannot claim parity with her.

Considering material on record as well as the conduct of the petitioner before the learned trial Court, prayer for bail is rejected at this stage.

The bail application is disposed of.

Case Diary be returned.

Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
