The petitioner claims to have been appointed as Cook and Peon for five years with the Officer-in-Charge of Excise, Egra Excise Circle of the State. The petitioner has not been able to produce any documents in this regard. 2.

The post of Cook and Peon is not a sanctioned post. The petitioner's engagement has not been in accordance with law and has also not followed any proper recruitment process.

Hence, no relief can be granted to the writ petitioner in the instant writ petition.

With the aforesaid observations, the writ petition is disposed of.

The aforesaid order shall not prevent the writ petitioner from approaching the Industrial Tribunal, if he can establish any right or seek any remedy in accordance with law.

There shall be no order as to costs.
