This revisional application has been preferred praying for a direction upon the learned trial court to dispose of the case being T.R. Case No. 262 of 2024 arising out of A.C. Case No. 819 of 2024 pending before the learned Judicial Magistrate, 4th Court, Alipore. 2.

Mr. Pattanayak, learned Advocate representing the petitioner, submits that the petitioner, being the legally married wife of opposite party No. 2, was driven out of her in-laws' house by the husband and his relatives. The petitioner has no independent income to maintain herself or her minor son and is in acute financial hardship. Faced with such circumstances, the petitioner filed an application under the relevant provisions of the Protection of Women from Domestic Violence Act, 2005 (for short, D.V. Act, 2005), seeking interim and permanent maintenance for herself and her minor son. He submits that the case was transferred to the learned Trial Court on 1.4.2024, and the opposite party entered appearance on 2.12.2024. However, to date, no interim maintenance has been awarded either in her favour or in favour of her minor son. He further submits that in the year 2025, dates were fixed or hearing of that application on 20.1.2025,

12.3.2025, 13.6.2025, and lastly on 24.11.2025, but the petitioner's prayer for interim maintenance has not yet been entertained. He prays that a direction be given to the learned court below to dispose of the petitioner's application for interim as well as permanent maintenance. 3.

Having heard the learned Advocate appearing for the petitioner and upon perusal of the materials on record placed before me, I do not find any impediment in accepting such an innocuous prayer of the petitioner.

In view thereof, the revisional application is disposed of by directing the trial court in-charge to make efforts to dispose of the application for interim maintenance within a period of three months from the date of receipt of a copy of this order. The trial court is also directed to take sincere efforts to dispose of the application for maintenance within a period of one year from the date of disposal of the interim maintenance application.
