The writ petitioners had applied for permission to hold peaceful 'Sit-in-demonstration' at Y Channel, Dharmatala to protest against alleged irregularities in process of recruitment to the post of Assistant Teachers which has been denied.

Appropriate justification is given by counsel for the State in this regard that, the said junction at Dharmatala is one of the main intersections of the State, through which heavy vehicles, inter alia, for construction of the metro railway regularly passes through.

Since the petitioners have sought an alternative place from the police for the said demonstration, the Joint Commissioner of Police, Head Quarter, Kolkata may allocate an appropriate place for the petitioners to hold peaceful 'Sit-in-demonstration' subject to any

condition that may be laid down in accordance with law.

Let the communication of such allocation be made to the petitioners within a period of seven days from the date of communication of a copy of this order by the respondent no. 3.

With the aforesaid observations, the writ petition is disposed of.

There will be no order as to costs.
