The revisional application was preferred against the order of maintenance passed by the Learned Additional Chief Judicial Magistrate, Siliguri, Darjeeling.
Learned Magistrate was pleased to award an amount of Rs.1500/- per month to be paid to the wife during the pendency of the main application under Section 125 of the Code of Criminal Procedure.
Having regard to the quantum of amount so granted by the learned Magistrate, I am of the view, no interference is called for.
The opposite party/wife will be entitled to recover the arrears by taking out an appropriate application before the Learned Magistrate.
Accordingly, CRR 2465 of 2012 is dismissed.
Interim order, if any, is hereby vacated.
All pending connected applications, if any, are consequently disposed of.
