For the Respondent No. 6. The grievance of the petitioner is directed against unlawful illegal construction by the private respondent.

It is submitted on behalf of the petitioner that the private respondents are illegally carrying out construction on a land which is classified as a pond. There is also an allegation that the private respondent is unauthorizedly carrying on construction on the land which belongs to the petitioner.

In this background the petitioner was compelled to file a representation with the Pradhan on 5th July, 2024. Notwithstanding, receipt of such representation the S.D.

respondent no. 7 being the concerned Pradhan has taken no steps in the matter.

The State is represented and submits that there

is no construction on land which is classified as a pond. The alleged land on which construction is supposed to take place is bastu land and there is no contravention of law.

In view of the above, WPA 18529 of 2024 stands disposed of by directing the respondent no. 7 to consider and dispose of the representation dated 5th July, 2024 within a period of six weeks from the date of communication of this order and in accordance with law after giving a right of hearing to all the parties. It is made clear that there has been no adjudication on the merits of the case and the respondent no. 7 is to act strictly in accordance with law without being influenced by any observation made in this order and after hearing all the affected parties.
