28.07.2023 Item No.63 Ct.No.34 Sayandeep C.R.R. 2740 of 2023 Sri Gopal Chandra Das versus Sri Kishore Kumar Jana Mr. Biswajit Sau Mr. Soham Sau ....for the petitioner The petitioner being the complainant in a case under Section 138 of the Negotiable Instruments Act is aggrieved by the factum that although the complaint was initiated in the year 2018 but till date there has been no progress in the case and the accused is appearing once the process of law is issued. Thereafter he is evading the process of law and again after few dates when warrant of arrest is issued again bail is being taken by him and his conduct being repeated. This Court directs the ACJM, Contai to pass directions upon the SDPO, Contai to produce the accused on the next date of hearing that is 01.09.2023.
The learned Trial Court would grant the accused bail and thereafter till the trial of the case is completed would direct the accused to attend and obtain an acknowledgement from the Inspector-in-charge/Officerin-Charge, Ramnagar P.S. in every alternate day till completion of the trial. The learned Trial Court would thereafter proceed with the trial of the case by fixing one date in every week so that the trial of the case can be taken to its logical conclusion within a reasonable period of time.
With the aforesaid observations, CRR 2740 of 2023 is disposed of.
Pending applications, if any, are also disposed of accordingly.
Leave is granted to the learned advocate for the petitioner to amend the cause title of the revisional application.
