This matter is appearing under the heading "To Be Mentioned". Pursuant to the direction passed vide order dated 19th October, 2023, the learned Registrar, L&OM has submitted her report dated 22nd November, 2023 annexing the reply submitted by Ms. Sikha Kar, Assistant Registrar (Court) on 8th November, 2023. The aforesaid report was called for since the final order was neither available in the case record nor the same was uploaded in the CIS server.

The Assistant Registrar (Court) in her reply dated 8th November, 2023 has stated that since the file after necessary correction was not sent to her by Assistant Court Officer (ACO) for retyping / incorporations and instead was sent to the department, the final typing of the order could not be done by her. The reply of the Assistant Registrar (Court) is silent with regard to whether she checked and/or verified the order of the said date to have finally been uploaded upon signature of the Judge concerned in respect of which dictation was taken by her on the said date. Accordingly, the Assistant Registrar (Court) is directed to transcribe the order dated 18th August, 2022 and send the file for my signature forthwith. After I put my signature on the said order by

giving date, the Assistant Registrar (Court) shall upload the said order in the CIS server. She is further directed to submit compliance report before the learned Registrar, L&OM in course of this day. Assistant Court Officer is directed to send the case file to the Assistant Registrar (Court) for such transcription. Learned Registrar, L&OM is directed to issue letter of caution to the Assistant Registrar (Court).

The Assistant Court Officer is directed to be more vigilant while dealing with the case files.

For regularization of the record, the signature in the aforesaid order after final transcription shall be made by me by giving date. Let a copy of this order be sent to learned Registrar, L&OM for information and necessary action.
